iHEARtest App Privacy Policy

This Privacy Policy explains how InnerScope Hearing Technologies, Inc. ("InnerScope," "we," "us," or "our") and its operating subsidiary OTCHealth Inc. collect, use, and protect information through the iHEARtest by OTCHealth mobile application (the "App") for iOS and Android. This policy applies only to the App. Use of the OTCHealthMart.com website is governed by our separate website Privacy Policy.

iHEARtest is a wellness tool, not a medical device

iHEARtest is a consumer hearing screening and education tool. It is not a medical device, is not FDA-cleared, and is not a substitute for a hearing evaluation by a licensed audiologist or physician. We are not a HIPAA-covered entity, and your use of the App does not create a doctor-patient relationship. If you have concerns about your hearing or sudden changes in hearing, please consult a qualified healthcare provider.

Information we collect

Information you provide

  • Optional account details such as your email address, first name, and ZIP code if you choose to sign up for tips, retest reminders, product launch alerts, or family profile features.
  • Hearing test responses you generate while using the App, including pure-tone test results, your "Hearing Number," simulator selections, decibel meter readings, family profile entries (up to six), and any tags you set inside the App.
  • Customer support communications if you email us or use in-app support.

Information collected automatically

  • Device identifier (a randomly generated, App-specific ID) used to associate your test results and preferences with your install.
  • App usage events such as: app installed, test completed, article read, simulator used, simulator shared, decibel meter used, tinnitus sound played, result shared, family invited, email captured, points redeemed.
  • Device information including operating system, OS version, App version, language, and timezone.
  • Push notification token if you grant notification permission, used solely to deliver retest reminders and feature announcements.

Microphone access

The App requests permission to use your device microphone for two specific features:

  • Hearing Test: the microphone is not used for the standard pure-tone test. Audio is played through your device speakers or headphones, and you tap when you hear it.
  • Decibel Meter and Word-in-Noise: the microphone is used in real time to measure ambient sound pressure level or to deliver the listening exercise.

We do not record, store, or transmit any audio captured by your microphone. Microphone input is processed on-device and discarded immediately. You can revoke microphone access at any time in your device settings.

Information we do not collect

We do not collect your precise GPS location, your contacts, your photos, your call logs, or audio recordings. iHEARtest has no backend server of its own, so your test history is stored locally on your device and does not sync across devices unless you explicitly share results.

How we use your information

  • To run the hearing test, decibel meter, simulator, and other features inside the App.
  • To send retest reminders, hearing health tips, and product announcements you have opted in to receive.
  • To improve the App through anonymized usage analytics.
  • To respond to your support requests.
  • To route you to relevant OTCHealthMart products, including TReO and Matrix hearing aids, when you tap a product link inside the App. Any purchase you make on OTCHealthMart.com is governed by the website's own privacy policy and terms.
  • To comply with applicable law.

We do not sell your personal information. We do not use your hearing test data for advertising. We do not share your test results with employers, insurers, or healthcare providers.

Service providers we use

We rely on a small set of vetted third-party service providers to operate the App:

  • Customer.io hosts our customer database and sends emails and push notifications you have opted in to. Customer.io receives your device identifier, optional email, event activity, and tags.
  • n8n (self-hosted at otchealth.app.n8n.cloud) proxies requests between the App and Customer.io. n8n does not store your data; it relays it.
  • Apple Push Notification service (APNs) and Google Firebase Cloud Messaging (FCM) deliver push notifications to your device.
  • Apple App Store and Google Play handle App distribution, crash reporting, and basic install metrics under their own privacy policies.

Each provider is contractually required to use your information only as needed to deliver their service to us.

Your choices and rights

In the App

  • Delete your data: open Settings inside the App and tap "Delete my data." This sends a delete request that removes your device profile and all associated events from Customer.io.
  • Reset local data: uninstalling the App removes all locally stored test history and family profiles from your device.
  • Push notifications: turn off in your device's notification settings.
  • Microphone: turn off in your device's permissions settings.
  • Email opt-out: click "unsubscribe" at the bottom of any email we send.

California residents (CCPA / CPRA)

If you are a California resident, you have the right to know what personal information we collect, to request deletion, to correct inaccurate information, to opt out of any sale or sharing of your personal information (we do not sell or share for cross-context behavioral advertising), and to be free from retaliation for exercising these rights. Submit requests to privacy@otchealthmart.com. We will verify your identity by matching the email address tied to your App profile.

EU and UK residents (GDPR)

If you are in the European Economic Area, the United Kingdom, or Switzerland, you have rights to access, correct, delete, restrict, or port your personal data, and to object to certain processing. Our legal basis for processing is your consent (for marketing communications and push notifications) and our legitimate interest in operating and improving the App. Submit requests to privacy@otchealthmart.com. You also have the right to lodge a complaint with your national data protection authority.

All other users

You can request access, correction, or deletion of your personal information at any time by emailing privacy@otchealthmart.com. We will respond within 30 days.

Children's privacy

iHEARtest is intended for adults age 18 and older. The Family Profiles feature is designed for an adult head of household to track hearing screening results for members of their household, including minor children, with appropriate parental supervision. We do not knowingly collect personal information directly from children under 13. If you believe a child under 13 has provided us with personal information without parental consent, contact us at privacy@otchealthmart.com and we will delete it.

Data retention

We retain your App profile and event history in Customer.io for as long as your install is active, plus 24 months of inactivity, after which inactive profiles are deleted. You may request earlier deletion at any time. Anonymized aggregate analytics may be retained indefinitely.

Data security

We use industry-standard encryption in transit (TLS 1.2+) for all data sent between the App and our service providers. Customer.io and our self-hosted n8n instance use access controls, audit logs, and encrypted storage. No method of transmission over the internet is 100 percent secure, and we cannot guarantee absolute security.

International data transfers

InnerScope and OTCHealth are based in the United States. If you use the App from outside the United States, your information will be transferred to and processed in the United States. We rely on standard contractual clauses and our service providers' compliance frameworks to safeguard data transferred from the EU, UK, and Switzerland.

Changes to this policy

We may update this Privacy Policy from time to time. We will post the updated version with a new "Last updated" date. Material changes will be communicated through the App or by email if we have your address.
